Minutes – Regular Meeting of Council

April 4, 2016

Council President Ricki Hastings opened the meeting at 7:00 pm. Council Members present were John Mazurowski, Tom Swisher, Ron Gallagher, Don Rehner, Sean McCalmont, Superintendent of Public Works Ken Boroski, Mayor Jim Swartz, Solicitor Gerald DeAngelis, Chief Jeff Swiklinski, and Treasurer Rich Hill.

The meeting was opened with the Pledge of Allegiance to the American Flag.

Agenda Minutes – Motion was made by John Mazurowski to approve the Agenda Minutes for the February 28, 2016 Agenda Meeting. The motion was 2nd by Ron Gallagher. Motion carried.

Minutes – Motion was made by Tom Swisher to approve the March o7, 2016 regular council meeting minutes.  The motion was 2nd by Ron Gallagher. Motion carried.

Treasurer’s Report – Motion was made by Don Rehner to approve the Treasurer’s Report. The motion was 2nd by Ron Gallagher. Motion carried.

Invoices – Motion was made by Don Rehner to approve the bills. The motion was 2nd by Ron Gallagher. Motion carried.

Public Works Report – Motion was made by Tom Swisher to approve the Public Works Report as written.  The motion was 2nd by John Mazurowski. Motion carried.

Police Report – Motion was made by Tom Swisher to approve the Police Report. The motion was 2nd by Ron Gallagher. Motion carried.

Mayor’s Report – The Mayor reported the new carpet had been installed in the police station.  Part-time Police Officer had submitted his resignation with the Borough.  Newly hired Part-time Police Officer Justin Reed will be on the schedule for the end of the month.

Solicitor’s Report – The Solicitor reported on the Fish and Boat Agreement that exhibits are not there, Borough must maintain the lot. August 1, 2021 is the deadline to file for a grant.  Mayor Swartz and Solicitor DeAngelis will set up a meeting with the Fish and Boat Commission to discuss the matter in further detail.

Citizen’s Comments – Mary Bowlin and Gail Murtland were here on behalf of the Renaissance Association to voice their concerns about the road closure of High Street between Fourth and Fifth being closed down for the Spring Fling on April 23, 2016 that it would cause problems for the people coming into Freeport.  Motion was made by Ron Gallagher not to close down High Street between Fourth and Fifth Streets due to the problems it would cause for the citizens.  Motion was 2nd by Don Rehner. Motion carried.  Motion was made by John Mazurowski for Freeport Renaissance Association’s request for the use of the gazebo.  Motion was 2nd by Ron Gallagher. Motion carried.

Public Works – Steve Greenberg from KLH Engineers, Inc. was present to discuss the Long Term Control Plan Project and schedule of the sewer system, everything is on schedule for Phase 1. Steve Greenberg requested that a letter be written to Upper Allegheny Joint Sewage Authority, we are still waiting on an agreement. Phase II plans of the LTCP need to be submitted by December 1, 2017.

The Borough has five bids come in for the street paving project:

Bids were opened at 1pm on April 04, 2016. Motion was made by Don Rehner to accept Derry Construction bid for option 1 for 75,261.00. Motion was s2nd by Sean McCalmont. Motion carried.

Street sweeping started April 1 and will run through November 1; Police will start ticketing cars on Friday April 8th.  Motion was made by Ron Gallagher to accept the bid from Beaver Jack to cut trees down. Motion was 2nd by Tom Swisher. Motion carried.

Public Safety – Motionw as made by Don Rehner to accept the resignation of Part-time Police Officer Eric Klopfer. Motion was 2nd by John Mazurowski with regrets. Motion carried.  Part-time Police Officer Dennis Lynch is waiting on his number to be put of the schedule. Motion was made to endorse the Mayoral Proclamation. Motion was 2nd by Sean McCalmont. Motion carried.

Parks, Recreation and Community – Motion was made by Tom Swisher to accept the FIBI 5K race route. The motion was 2nd by John Mazurowski. Motion carried.  Motion was made by RDon Rehner to approve the request from St. Mary’s Church for the closure of Riverside Drive between 4th and 5th Streets, with the written consent from the Terminals to close down Riverside Drive.  Motion was 2nd by John Mazurowski. Motion carried.

Finance – Ron Gallagher reported that there were 15 delinquent accounts that have not been paid from the 48 hour postings. John Mazurowski reported that the Borough received $2,837.00 from Sharp Collections for the month of March.  John Mazurowski attended BCTCC, which celebrated their 50th anniversary.

Property and Ordinance – Motion was made by Sean McCalmont to accept the Boat and Park Ordinance as advertised. Motion was 2nd by Ron Gallagher. Motion carried.  Motion was made by Sean McCalmont to pass the Weed Ordinance as advertised.  Motion was 2nd by Ron Gallagher. Motion carried. There is not progress to report on the Deveraux Lease, Solicitor DeAngelis will get in touch with Deveraux legal counsel.

Technology – The Borough website is up and running.  Council decided to follow through with using RT Services for the Borough’s IT services.

Personnel – Ron Gallagher nominated Matt Crytzer to fill the Council vacancy. Motion was made by Ron Gallagher to accept Matt Crytzer to fill the Council vacancy. Motion was 2nd by John Mazurowski. Motion carried.  Motion was made by Don Rehner to authorize Ricki Hastings to be the voting delegate for the PSAB. Motion was 2nd by Sean McCalmont.  Motion carried.

Council called for Executive Session at 9:00 to discuss Police Personnel, Pension Plan and upcoming Litigation.

Council returned from Executive Session at 9:40pm.

Council President Ricki Hastings reported that no straw votes were taken and no action taken.

A motion was made by Don Rehner at 9:41pm to adjourn the meeting. Motion was 2nd by Ron Gallagher. Motion carried. Meeting Adjourned.
